L8 Street GmbH
1. AREA OF APPLICATION & CONTRACTUAL PARTNERS

These GTC apply to all contracts for the rental of apartments for accommodation concluded between L8 Street GmbH (L8 Street) and third parties (guests), as well as for all other services and deliveries provided by L8 Street GmbH (accommodation contract).

In principle, the contractual partner of the guest in Germany is L8 Street GmbH.
2. RESERVATIONS

By making a reservation, the guest offers to conclude an accommodation contract. If the booked apartment is available, the guest will receive a reservation confirmation from L8 Street. This acceptance of the reservation made by the guest creates an accommodation contract between L8 Street and the guest.

L8 Street's offers regarding available apartments are subject to change and non-binding. L8 Street may, at its own discretion, refuse to enter into an accommodation contract.

There is no entitlement to use the overnight service in a specific apartment. L8 Street reserves the right to impose industry-standard restrictions such as minimum stays, booking guarantees or deposits for specific dates.
3. CANCELLATION PERIODS
-
A reservation can be canceled free of charge by the guest in accordance with the cancellation conditions shown, stating the reservation number. After the cancellation period has expired, cancellation is excluded and L8 Street retains the right to the agreed remuneration. The same applies if the guest fails to appear (no show).

Unless otherwise stated, the following cancellation policies apply:

For stays longer than 28 days:

Free cancellation up to 7 days before the start of your stay

Refund of 50% of the booking amount if canceled up to 3 days before the start of the stay

From 3 days before the stay begins, a refund of the booking amount is no longer possible
-
If no fixed date for the end of the stay was agreed upon, the cancellation deadline is 14 days to the following month
-

For stays of less than 28 days:

Free cancellation up to 3 days before the start of your stay

Refund of 50% of the booking amount if canceled up to 1 day before the start of the stay

From the day on which the stay begins, a refund of the booking amount is no longer possible

If no fixed date for the end of the stay was agreed upon, the cancellation deadline is 7 days to the following invoice cycle

4. ACCOMMODATION PRICES & OTHER PRICES

The prices shown by L8 Street at the time the contract was concluded apply. The applicable prices are total gross prices and include all statutory taxes, fees and charges. Not included and calculated separately are local taxes that are owed by the guest themselves according to the respective municipal law, such as visitor's tax.

In the event of changes in tax, fee and duty rates and effective collection new taxes, fees and charges previously unknown to the parties, L8 Street reserves the right to adjust the prices accordingly. In the case of contracts with consumers, this only applies if the period between the conclusion of the contract (booking confirmation) and the adjustment of the contract exceeds four months.
5. TERMS OF PAYMENT & INVOICE

The price of the entire booked accommodation service must always be paid in advance by the guest.

A set-off by the guest is excluded, unless the set-off relates to an undisputed or legally established claim.

Valid means of payment are MasterCard, Visa Card, American Express, GiroPay, SofortÜberweisung - cash payments are excluded.
-
L8 Street reserves the right to debit the deposited means of payment with the outstanding amounts for subsequently incurred fees due to additional services used or violations of the General Terms and Conditions.

The guest agrees that an invoice will always be made available as a download or by e-mail in the regular case. If the guest wishes a postal delivery deviating from this, there may be an extended delivery time due to home office regulations and organizational reasons. L8 Street also reserves the right to comply with requests for a company stamp or signature on the invoice for the reasons stated above.
6. USES OF RESERVED APARTMENTS

A reserved apartment is available to the guest from 4 p.m. on the day of arrival and until 12 p.m. on the day of departure.

Unless otherwise agreed, the keys provided must be returned to L8 Street on the agreed departure date by depositing them in the key box used at check-in. If a key that has been handed out is lost or not handed in upon departure, a fee of EUR 40.00 will be charged. L8 Street remains entitled to demand compensation from the guest for any damage incurred as a result, insofar as this exceeds the amount of EUR 40.00. This includes the costs for replacing the affected locking system, insofar as this is necessary for security reasons.

Late check-out can be arranged in advance with L8 Street upon request and subject to availability. If L8 Street agrees to a late check-out, L8 Street is entitled to charge EUR 10.00 per hour or part thereof for the additional use of the apartment. For departures after 2 p.m., the full daily rate of the apartment will be charged. There is no contractual right to a late check-out.

Upon request and subject to availability, early check-in can be arranged with L8 Street in advance. If L8 Street agrees to an early check-in, L8 Street is entitled to charge EUR 10.00 per hour or part thereof for the additional use of the apartment. There is no contractual right to an early check-in.
7. RESALE

The resale/rental and/or the brokering of booked apartments is prohibited. In particular, the forwarding of apartments and/or apartment contingents to third parties at higher prices than the actual apartment prices. The assignment or sale of the claim against L8 Street is also not permitted. In these cases, L8 Street is entitled to cancel the booking, especially if the guest has given false information to the third party about the type of booking or the payment during the assignment/sale.

Any use of the apartment for purposes other than accommodation, in particular any commercial use by the guest, is expressly prohibited.
8. LIABILITY OF L8 Street

L8 Street has unlimited liability for damage to life, limb or health for which it is responsible. Furthermore, L8 Street is liable for other damages that are based on an intentional or grossly negligent breach of duty by L8 Street. L8 Street is only liable for simple negligence and limited to the foreseeable damage typical of the contract if an obligation is breached, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which you as a guest can regularly rely (cardinal obligation). A breach of duty by L8 Street is equivalent to that of its legal representatives, employees or vicarious agents. Further claims for damages are excluded, unless otherwise regulated in these General Terms and Conditions.

If disruptions or defects in the services of L8 Street occur, L8 Street will endeavor to remedy the situation if the guest is aware of it or if the guest complains immediately. The guest is obliged to do what is reasonable for him to remedy the disruption and to minimize possible damage. In addition, the guest is obliged to inform L8 Street in good time of the possibility of exceptionally high damage occurring.

L8 Street is liable for items brought in according to the statutory provisions. The claim expires if the guest does not report the loss, destruction or damage to the item brought to L8 Street immediately after becoming aware of it, unless this delayed notification has no effect on the clarification of the facts. If the guest wishes to bring money, securities and valuables with a value of more than EUR 800 or other items with a value of more than EUR 3,500 into the apartment, this requires a separate written agreement with L8 Street.

If the guest is provided with a parking space, even for a fee, this does not result in a safekeeping contract. L8 Street is not obligated to monitor. In the event of loss or damage to motor vehicles or bicycles parked or maneuvered on the property or their contents, L8 Street is only liable in the event of intent or gross negligence. The guest is obliged to report any damage immediately, obvious damage, at least before leaving the parking facility. L8 Street is not liable for damage for which other tenants or other third parties are solely responsible.

All claims against L8 Street generally lapse within one year from the start of the statutory limitation period. This does not apply to claims for damages or other claims arising from injury to life, limb or health and/or due to grossly negligent or intentional breach of duty by L8 Street and in the event of breaches of a cardinal obligation within the meaning of Section 8a.

L8 Street accepts no liability for lost property. Excluded from this is liability due to intentional or grossly negligent breaches of duty by L8 Street. Lost property will only be returned on request for a fee and a processing fee of EUR 10.00. The accommodation company undertakes to store it for a period of six months.
9. DEPOSIT OF SECURITY

In order to secure all claims of L8 Street against the guest arising from the accommodation contract, the guest shall provide the following before the apartment is rented out:

in the case of an agreed rental period of less than three months, a security in the amount of EUR 500.00,
-
in the case of an agreed leasing period of three to six months, a security in the amount of EUR 2,000.00.

In the case of an agreed rental period of less than six months, the accommodating company may carry out a pre-authorization on the guest's payment card to compensate for the security deposit. If the security is not provided by the time the apartment is handed over, the guest has no claim to the apartment being handed over. If L8 Street has nevertheless provided the guest with the apartment, L8 Street is entitled to terminate the accommodation contract without notice if the deposit is not paid within a reasonable grace period to be set by the accommodation provider.

L8 Street is obliged to settle the deposit within one month after the end of the accommodation contract.
10. CUSTOMER DATA

In order to ensure communication with the guest, L8 Street is required to collect the e-mail address and telephone number. To verify the identity of the guest, L8 Street is entitled to digitally request the following valid identification document (for domestic guests an identity card or passport; for foreign guests the passport) and valid credit card data at check-in.

If the identity of a guest cannot be clarified beyond doubt due to missing or incorrect documents, L8 Street is entitled to cancel the booking.

To avoid defective bookings, L8 Street uses software solutions that use the requested data (e-mail address, home address, telephone number, credit card, etc.) to determine a so-called "fraud prevention score" for each guest and identify defective bookings. Should the software recognize such a booking, L8 Street reserves the right to cancel the booking.
11. TERMINATION OF ACCOMMODATION AGREEMENT

L8 Street is entitled to terminate the accommodation contract for good cause. An important reason exists in particular if (i) force majeure or other circumstances for which L8 Street is not responsible make it impossible to fulfill the contract, (ii) apartments are booked culpably with misleading or false information or with the concealment of essential facts; The identity of the guest, the ability to pay or the purpose of the stay can be essential, but not exclusively, (iii) L8 Street has reasonable grounds to assume that the use of the service may jeopardize the smooth running of business, safety or publicity of L8 Street and its locations outside of L8 Street's control or organization; (iv) the purpose or reason for the stay is unlawful; or (v) in the event of resale/rental and/or onward brokerage (see Clause 7).

L8 Street must inform the guest immediately of the exercise of the right of termination.

In the event of justified termination by the accommodation facility, the guest is not entitled to compensation.
12. VOUCHERS
-
A voucher purchased from L8 Street can only be redeemed for L8 Street services. If there are any remaining credit balances when paying with the voucher, they remain in place and can be used for further bookings. Vouchers are non-returnable, non-resalable, non-transferable and non-redeemable for cash. The person ordering the voucher is responsible for providing the correct data (in particular the e-mail address) to which the voucher and the invoice should be sent.

Cancellation policy: Declarations on vouchers can be revoked within 14 days without giving reasons in any form (letter, fax, e-mail) or, if the voucher is provided before the deadline, also by returning the voucher. The period begins after receipt of this instruction in text form, but not before receipt of the voucher by the recipient. To meet the cancellation deadline, it is sufficient to send the cancellation or the voucher in good time. The revocation must be sent to L8 Street GmbH, keyword: voucher; by email: info@L8Street.com.
13. NO SMOKING IN THE APARTMENT

The L8 Street Apartments are non-smoking apartments. It is therefore forbidden to smoke both in the common areas and in the guest apartments. In the event of an infringement, L8 Street has the right to demand an amount of at least EUR 500.00 from the guest as compensation for the cleaning costs to be paid separately, including any loss of revenue from the apartment being unable to be rented as a result. This amount of compensation is to be set higher if L8 Street proves greater damage.

Tampering with or blocking of emergency exits, fire extinguishers or the fire alarm is prohibited. Violations will result in a fine of €150.
14. NO ALCOHOL IN THE APARTMENT

Bringing or consuming alcoholic beverages is prohibited.
-
Holding parties is not allowed at L8 Street Apartments.
-
In the event of an infringement, L8 Street has the right to demand an amount of EUR 500.00 from the guest as compensation for the cleaning costs to be paid separately, including any loss of revenue from the apartment being unable to be rented as a result. This amount of compensation is to be set higher if L8 Street proves greater damage.
15. DAMAGE OR THEFT

If damage occurs that goes beyond normal use, or theft, L8 Street has the right to charge the guest for the damage as well as the separate expenses for repairing the damage, including any loss of revenue from the apartment being unable to be rented as a result.
16. PETS
-
Bringing a pet is not allowed. However, guide dogs, deaf dogs and other comparable service dogs are exceptions. These may be carried free of charge and at any time against proof.
17. MAINTENANCE
-
The guest undertakes to treat the apartment provided, the furnishings and the rooms, facilities and systems intended for communal use with care and care and to ensure proper ventilation and heating.

The guest also undertakes to check the facility for completeness and usability when moving into the apartment and to report any complaints to the accommodation provider immediately.
-
The guest is liable for all damage to the rented apartment, the furnishings and the rooms, facilities and systems intended for communal use, which he or his visitors culpably caused through use contrary to the contract and which cannot be attributed to normal wear and tear. The guest must notify L8 Street immediately of any damage to the apartment provided.

The apartment is regularly cleaned by L8 Street. The guest will grant the service provider commissioned by L8 Street access to the apartment. The guest agrees that cleaning service providers can enter the rented apartment with a second key after prior notification by ringing the bell and waiting a reasonable time.
18. GROUP BOOKINGS/ALLOCATION AGREEMENTS/EVENT TIMES

For group bookings of more than five apartments and contingent contracts, separate payment and cancellation conditions apply, which result from the corresponding contracts.

Different cancellation deadlines apply to bookings made during events and trade fairs. These are shown in the booking process and on the booking confirmation.
19. INTERNET USE
-
L8 Street provides the guest with internet access within the scope of the existing technical and operational possibilities. Disturbances, for example due to force majeure, maintenance measures or similar cannot be ruled out.

The guest may not misuse the internet connection. Misuse occurs in particular in the following cases: Downloading and distributing copyrighted content via peer-to-peer sharing platforms, illegal streaming offers and the posting, retrieval or transmission of criminally relevant content (in particular Sections 130, 130a, 131 and 184 StGB). The guest is obliged to observe the copyright, patent, name, trademark and personal rights of third parties during use. Upon first request, the guest indemnifies L8 Street from all third-party claims and claims for damages, as well as from the costs of legal defense in an appropriate amount, which are caused by illegal use of the provided internet connection by the guest or by third parties with the knowledge of the guest have been caused. This right to indemnification includes in particular claims arising from the violation of copyright, patent, name, trademark and personality rights as well as violations of data protection law.

The guest is prohibited from passing on the access data for the Internet connection to third parties. In the event of an infringement, the guest is responsible to L8 Street for any damage caused by the disclosure of the access data.

In addition, L8 Street reserves the right to block the guest's Internet connection in the event of legal violations.
20. PRIVACY

21. FINAL PROVISIONS

Changes and additions as well as the cancellation of the accommodation contract, the acceptance of applications or these general terms and conditions must be in writing. This also applies to the cancellation of this written form clause. Unilateral changes or additions by the guest are invalid.

The place of performance and payment is the registered office of the accommodation provider.
-
The exclusive place of jurisdiction for commercial transactions is the registered office of the accommodation facility. If a contractual partner meets the requirements of § 38 paragraph 2 ZPO and does not have a general place of jurisdiction in Germany, the place of jurisdiction is the registered office of the accommodation company.

German law applies. The application of the UN sales law and the conflict of laws is excluded.

Should individual provisions of these General Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions. In addition, the statutory provisions apply.

The accommodation provider is neither willing nor obliged to participate in a dispute settlement procedure before a consumer arbitration board.
